Stars Denied Bid to Reopen Bankruptcy Case in Legal Bout with Mavs
In a recent legal development, a United States Bankruptcy Court judge in Delaware has denied the Dallas Stars' request to reopen their 2011 bankruptcy case, dealing an early setback to the NHL team in its ongoing legal dispute against the NBA's Dallas Mavericks. The judge, Karen B. Owens, stated that the Texas Business Court is the appropriate venue to address these issues, emphasizing that the court can determine the matters in the ordinary course of business. She advised the Stars to focus their efforts in Texas, where the case will now proceed.
The legal battle revolves around the Mavericks' alleged breach of their franchise agreement with the City of Dallas by relocating their headquarters to Frisco in 2003. The Stars have filed a countersuit, accusing the Mavericks of violating their own franchise agreement by changing their principal location to Las Vegas in 2024 during Mark Cuban's sale to Miriam Adelson and the Dumont family. The Stars argued that the Mavericks were aware of their Frisco headquarters in 2011 and that the bankruptcy case's confirmation order should prevent future objections to the agreed-upon terms.
Jim Lites, the Stars' CEO for nearly 25 years, testified that he and the Mavericks' former counterpart, Terdema Ussery, held numerous meetings in Frisco during the early 2000s, suggesting the Mavericks' knowledge of the Stars' non-Dallas headquarters. The Stars' legal counsel, Annmarie Chiarello, emphasized the court's ability to enforce its own orders and retain jurisdiction.
The Mavericks, on the other hand, argued that the parties in the current Texas Business Court lawsuit are different from those in the bankruptcy case, and that they did not receive notice of the bankruptcy. The case will now proceed in Texas, with a virtual hearing scheduled for January 22, followed by a potential summary judgment hearing on January 26.
